SUPER 8 SCREEN PASS CONTEST
OFFICIAL CONTEST RULES
1.NO PURCHASE NECESSARY TO ENTER OR TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2.TO ENTER AND PLAY: Contest will begin May 27, 2011 at 12pm and end on June 2, 2011 at 8ampm (the “Contest Period”). You can enter by during the Contest Period. KFOX TV will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or sponsor. In the event of a dispute, all email entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by KFOX TV in its sole, reasonable discretion, and KFOX TV reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the contest.
3.ELIGIBILITY: Contest open only to residents of the states of New Mexico and Texas who are 13 years of age or older as of the date of entry. Contestant must also be a US citizen. Contest is not open to employees of Cox Enterprises, Inc., Cox Media Group, Inc., KFOX TV and each of their respective affiliates, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees. Contestants may enter the Contest as many times as they wish.
4.PRIZES: One hundred (50) winners will be chosen by random drawing on or about June 2, 2011 at 12pm. Each winner will receive two (2) pass(es) to a screening of Super 8 on Tuesday, June 7th at 7:30pm at Cinemark West El Paso 14. ARV of each pass: $7.50. Total ARV of all prizes to be awarded in the Contest: $750.
SCREEN PASSES ARE NOT ACTUAL TICKETS. PASSES MUST BE EXCHANGED FOR THE TICKETS ON THE SCREENING DATE, AND TICKETS ARE ALLOTTED ON A FIRST COME, FIRST SERVE BASIS. Screen pass issuer terms may apply.
Limit: One (1) prize per person and per household.
5.ODDS: Odds of winning depend on the number of eligible entries received.
6.WINNER NOTIFICATION AND ACCEPTANCE: KFOX TV will contact each winner directly using the email address provided on the winner’s entry form. Winner will be emailed a link that will provide them with their printable pass. KFOX TV’s inability to reach a winner, the failure of a winner to timely respond to any notification, or the return of any prize notification as undeliverable may, in the sole discretion of KFOX TV, result in the disqualification of the winner and the selection of an alternate winner from among all eligible entries received. Sponsor will select up to 10 alternate winners for a prize, after which that prize will remain unawarded. Winners may waive their right to receive a prize. Prizes are non-assignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and KFOX TV reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for payment of any taxes on any prize. Winners may be required to provide their Social Security Numbers to Sponsor and/or complete an IRS W-9 form in order to claim their prize. KFOX TV makes no representation regarding tax consequences associated with any prize. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within 14 days of date of postmark. Failure to sign and return the affidavit or release within 14 days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of KFOX TV, result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the selection of an alternate winner from among all eligible entries received as described above. Except where prohibited, participation in the contest constitutes entrant's consent to the publication of his or her name, voice, likeness, background information, and image in any media for any commercial or promotional purpose, without limitation or further compensation.
7.PARTICIPATION: Participation in the contest constitutes an agreement by each contestant to comply with these Official Contest Rules. By entering online, participants further agree to be bound by the terms relating to the use of KFOX TV's website, including its Privacy Policy. KFOX TV reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by KFOX TV. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of KFOX TV which corrupts or impairs the administration, security, fairness or proper operation of the contest, KFOX TV reserves the right in its sole discretion to suspend, modify or terminate the contest entry on KFOXTV.com. Should the Contest be terminated prior to the stated expiration date(s), KFOX TV reserves the right to award prizes based on the entries received before the termination date.
8.CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of any contestant and KFOX TV, shall be governed by, and construed in accordance with the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of Texas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Texas. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9.GENERAL RELEASE: BY ENTERING THE CONTEST, ENTRANTS RELEASE KFOX TV, COX MEDIA GROUP, INC., COX ENTERPRISES, INC., ANY OTHER PROMOTIONAL SPONSORS, AND EACH OF THEIR RESPECTIVE AFFILIATED COMPANIES, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, PARTNERS AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE CONTEST OR WITH THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES OR DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO, LOSS OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT).
BY ENTERING THE CONTEST, ENTRANTS ACKNOWLEDGE AND AGREE THAT THE CONTEST, INCLUDING ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
ENTRANTS AGREE THAT THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE CONTEST; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE CONTEST; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE CONTEST OR THE PROCESSING OF ENTRIES; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANTS’ PARTICIPATION IN THE CONTEST OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.
Only the number of prizes stated in these Official Rules is available to be won in the Contest. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, KFOX TV reserves the right to award the prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.
10.SPONSOR: The "Super 8 Screen Pass Contest" contest is sponsored by KFOX TV whose decisions regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. KFOX TV and KFOXTV.com will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials relating to the contest. KFOX TV and its sponsor(s) reserve the right to cancel this or any contest without any notification to its contestants.
